These Terms of Service ("Terms") govern your access to and use of the AssistLynk internal communications and message management platform (the "Service"), provided by [Your Company Name] ("Company," "we," or "us").
By accessing or using AssistLynk, you agree to these Terms. This service is for authorized employees only and is strictly for legitimate Company business purposes.
1. Core Function of AssistLynk
The AssistLynk platform is an official Company tool with a dual purpose:
- Active Business Communication: To enable employees to send and receive official Company communications with clients, vendors, and internal personnel via integrated channels (including Company Email, WhatsApp (WA), and SMS).
- Data Management and Archiving: To automatically capture, process, and retain all work-related communications sent and received through the integrated channels for the purpose of regulatory compliance, operational review, and record-keeping.
2. No Expectation of Privacy and Monitoring
YOU HAVE NO EXPECTATION OF PRIVACY IN ANY COMMUNICATION, DATA, OR ACTIVITY CONDUCTED OR STORED ON ASSISTLYNK.
- Company Property: All data, communications, attachments, logs, and activity records generated, processed, or stored within AssistLynk are the exclusive property of the Company.
- Consent to Monitoring: By using the Service, you consent to the Company monitoring, auditing, reviewing, and disclosing all content and metadata (including sender, recipient, time, and content) for purposes including, but not limited to, compliance, security, investigation, and quality assurance.
- Scope: This monitoring applies to all integrated communications, regardless of the underlying device (Company-provided or personal) used to access AssistLynk.
3. Use of Personal Devices (BYOD Policy)
Your use of AssistLynk on a personally-owned device requires adherence to the following conditions:
- Required Integration: To perform your job duties, you must integrate your work-related communication accounts (e.g., a WhatsApp account approved for client communication) with the AssistLynk Service, which is installed on your device.
- Limited Scope of Access: The Company's access via AssistLynk is strictly limited to the communications data that is processed or archived by the AssistLynk application itself and is related to Company business.
- Irreversibility: You acknowledge that once work-related communications are processed by AssistLynk, they become Company records and are subject to these Terms, even if the communication was originally sent from a personal device or account.
- Removal of Data: You agree that upon termination of your employment or cessation of your use of the Service, you will cooperate with the Company to ensure all Company data and access from your personal device is permanently and securely removed in accordance with the Company's IT policy.
4. Employee Conduct and Content Restrictions
You agree that your use of AssistLynk will be professional, lawful, and compliant with the Company's [Link to Employee Handbook/Code of Conduct]. Prohibited activities include, but are not limited to:
- Personal Use: Sending or receiving non-business-related messages (other than incidental, minimal use) via integrated channels.
- Sensitive Data: Transmitting highly sensitive personal information, proprietary secrets, or non-public data (like customer IDs or health records) unless explicitly authorized and secured.
- Misconduct: Posting or sharing any harassing, discriminatory, offensive, defamatory, or unlawful content.
- System Abuse: Attempting to circumvent the archiving or logging functionality of AssistLynk or deleting records contrary to Company policy.
5. Termination of Access
The Company reserves the right, in its sole discretion and at any time, to terminate or suspend your access to AssistLynk, particularly in cases of suspected violation of these Terms or other Company policies.
6. Acknowledgement
By clicking "Accept" or continuing to use AssistLynk, you affirm that you understand the terms, including the lack of privacy in communications on the Service and the requirements for using the Service on personal devices.
7. WhatsApp Business API Terms
The following additional terms apply when using the WhatsApp Business integration features of AssistLynk:
7.1 Compliance with WhatsApp Policies
By using the WhatsApp integration, you agree to comply with:
- WhatsApp Business Policy
- WhatsApp Commerce Policy
- Meta Advertising Policies (for promotional messages)
- All applicable local laws and regulations regarding electronic communications
7.2 Permitted Use of WhatsApp Messaging
WhatsApp messaging through AssistLynk may only be used for:
- Customer service and support communications
- Order confirmations and shipping updates
- Appointment reminders and scheduling
- Account notifications and alerts
- Responses to customer-initiated inquiries
- Marketing messages only with explicit customer opt-in consent
7.3 Prohibited WhatsApp Content
The following content is strictly prohibited when using WhatsApp through AssistLynk:
- Spam or unsolicited bulk messaging
- Deceptive, misleading, or fraudulent content
- Adult content, gambling, or illegal substances promotion
- Harassment, threats, or abusive language
- Content that violates intellectual property rights
- Political advertising or content without proper disclosure
- Health claims that are not verified or approved
- Any content that violates WhatsApp's Community Guidelines
7.4 Message Templates
When sending template-based messages (notifications outside the 24-hour customer service window):
- Templates must be approved by Meta before use
- Templates must accurately represent the message purpose
- Businesses must maintain records of customer opt-in consent
- Template misuse may result in account suspension
7.5 Customer Consent and Opt-Out
Businesses using WhatsApp through AssistLynk must:
- Obtain explicit consent before initiating WhatsApp communications with customers
- Provide clear opt-out mechanisms in all marketing communications
- Honour opt-out requests promptly (within 24 hours)
- Maintain records of consent for compliance purposes
7.6 Account Suspension and Termination
Meta and AssistLynk reserve the right to suspend or terminate WhatsApp access if:
- Quality rating falls below acceptable thresholds
- Policy violations are detected
- Customer complaints exceed normal levels
- Spam or abuse is identified
8. Third-Party Services
AssistLynk integrates with third-party services including but not limited to Meta Platforms (WhatsApp, Facebook), Twilio (SMS, Voice), and Microsoft (Email). Your use of these integrations is subject to the respective third-party terms of service. AssistLynk is not responsible for the availability, reliability, or policies of third-party services.
9. Limitation of Liability
To the maximum extent permitted by law, AssistLynk and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to message delivery failures, data loss, or third-party service interruptions.
